PRIVACY AND DATA SECURITY NOTICE

This document explains how your personal information is collected, used, and protected under which legal framework. Please read carefully. By using the platform, you give explicit consent for your personal data to be processed in accordance with this policy, and acknowledge the inherent risks of the digital environment.

1. Scope and Sources of Collected Data

The AzFreelance platform collects the following personal and technical data to provide its services:

Registration Information: First Name, Last Name, Email address, WhatsApp number, Password (stored as cryptographically secured Hash).
Profile and Job Data: Professional experience, portfolios, skills, ratings, and correspondence between client/freelancer.
Automatically Collected Data: IP address, device model, operating system, browser type, user flow, platform access times, and navigation data.

🛡️2. Limitation of Liability for Cyberattacks and Data Breaches

2.1. Security Measures: Standard security algorithms (SSL encryption, firewalls, and password hashing) are applied to protect your data.

2.2. Data Breach Disclaimer: The digital and global internet network cannot be 100% secure. In the event of hacker attacks, server breaches, external software intrusions, or force majeure events resulting in personal data, including internal correspondence (chats), phone numbers, or emails, falling into the hands of 3rd parties (cybercriminals), AzFreelance fully disclaims ALL direct and indirect material and moral liability. By using the platform, the user confirms they fully understand and accept this technological risk.

2.3. Payment and Financial Information: Our platform DOES NOT STORE your bank card (credit card) details ON ITS SERVERS. Payment transactions are carried out via the following licensed payment gateways depending on the platform type:

Website (azfreelance.az): Epoint — a local payment system licensed by the Central Bank of Azerbaijan. Your card details are stored in encrypted form solely on Epoint's infrastructure.
Mobile App (Android): Google Play Billing — payment system operated by Google LLC. Google's privacy policy applies.

3. Data Sharing with Third Parties

AzFreelance DOES NOT SELL user data to external companies for commercial purposes.

However, your data may be shared in the following specific cases and within a legal framework:

Law Enforcement Agencies: Upon official court order, official government request, or an investigation related to cybercrime (fraud), the platform unconditionally reserves the right and obligation to hand over data.
Service Providers: Encrypted data exchange in transit may occur with global hosting, cloud systems, email, and SMS providers that ensure the platform's operation.

🤖4. Content Analysis by Artificial Intelligence (AI)

4.1. AI Scanning: To ensure the security of the AzFreelance ecosystem, EVERY piece of content shared on the platform (job postings, submitted proposals, user portfolios, and even one-on-one messages / chats between users) is scanned and automatically analyzed by global Artificial Intelligence (AI) moderation engines to prevent fraud (scams), illegal job offers, and malicious code.

4.2. Inviolability of Information: The AI is solely for security analysis (Pattern Recognition). Secrets, codes, or project details in your private messages are not used for commercial purposes, are not stored to train any AI model, and are not sold.

5. User Rights and Account Deletion

5.1. Rights (GDPR-like Format): You can view and edit your personal data at any time.

5.2. Full Data Deletion: You can permanently delete your account at any time using the Settings → Danger Zone menu. In this case, your name, email, and number will be deleted from our database.

5.3. Exceptions (Retained Data): To prevent fraud and reporting errors, the following data may be kept in special archives on the system even if the account is deleted:

Audit and Financial Transactions (spent or canceled for Boosts, etc.).
If a user is "Banned" (blacklisted), their IP and Email archive in Hash format is retained to prevent them from accessing the platform again.

6. International Data Transfer

6.1. Third-Party Service Providers: AzFreelance provides its technical services via reliable global service providers. By using the platform, you consent to your data being stored on these providers' servers — including outside Azerbaijan (in the US, UK, and other countries). Service categories used:

Web Hosting and Cloud Infrastructure: Server, CDN, and database services ensuring platform operations (US servers);
Media Storage Service: Storage of user-uploaded images and files;
Real-time Communication Service: Internal messaging and notification infrastructure;
AI Moderation Service: AI analysis system for automatic text and image checking;
Payment Processing (Web): Local payment infrastructure licensed by the Central Bank of Azerbaijan;
Mobile Payment (Android): Payment infrastructure of Google's official app store;
Authentication Service: OAuth providers for account login.

6.2. Data Minimization Principle: AzFreelance shares only the minimum data technically necessary for service provision with these providers. Each provider operates under its own privacy policy. AzFreelance is not liable for technical failures or data loss in the providers' infrastructure.

7. Data Retention

AzFreelance retains your data for the period necessary to provide the service, ensure security, and fulfill legal obligations:

Active account data (name, email, number): Retained as long as the account is active. Upon deletion, this data is immediately anonymized — registered as "Deleted User", personal identifiers destroyed.
Financial transactions (Spark purchases, Boost payments): Financial records (payment date, amount) are retained indefinitely — for accounting, dispute resolution, and fraud prevention purposes.
Messages and correspondence: Retained for the period necessary to provide the service. Account deletion does not automatically delete message history.
Audit logs (activity history): Retained indefinitely for platform security monitoring.
Banned account archive: IP and email hash are archived permanently to prevent the person from opening a new account.

Note: To request data deletion, write to [email protected]. Data within legal obligations may be excluded from the request.

8. Children's Privacy

8.1. Age Restriction: The AzFreelance platform is not directed at persons under 18 and knowingly collects no personal data from them. If you become aware that a minor you are the parent/guardian of has registered on the platform, immediately notify [email protected].

8.2. In Case of Discovery: Upon becoming aware of such a situation, all data of that user — excluding audit archives with unexpired legal terms — will be deleted immediately.

In accordance with the Law of the Republic of Azerbaijan "On Personal Data" (2010), you may also submit your complaint via the Ministry of Digital Development and Transport of the Republic of Azerbaijan.
